I admit that I gag everytime I hear the phrase, “Rule-Based-International-Order,” or its variants, having served as defense attorney at Guantanamo. There, I observed directly how the Military Commissions Act we operated under was “Outside the Law,” in fact,
as it represented the “nullification” of “law.” Instead, it substituted the legal regime of the sort required under the Cheney/Wolfowitz Doctrine of US Global Military Domination: Global Martial Rule. Which a proponent of it, in essence, Benjamin Wittes, once
let slip that the US regime was exercising in fact.
But the Office of Legal Counsel Opinions prepared under the Bush/Cheney regime, specifically that of October 23, 2001, constructively constituted a “declaration of martial law,” to be applied globally, and domestically, by giving at a minimum authority to a
DOD agency, the NSA, to “spy” on all Americans, and the rest of the global population. That was, and is, “Martial Rule.” I wrote on this for an M.A. thesis in 2018, with the attached Word file prepared as a partial work copy, so largely unedited in this form.
But I am reminded of "martial rule” given the popularity it has with Republicans, Conservatives, and far, far too many Democrats. And libertarians, as shown by the libertarian economist Thomas Sowell, who once published his rumination that perhaps the US was
in need of a “military coup,” which martial rule necessarily accompanies. Little wonder that a “libertarian” supports draconian military measures, notwithstanding their occasional protestations against force, when so many of them reveal their Neitzschean roots,
as a 2009 (positive) biography of Ayn Rand, with her an admirer of the would-be military Caesar: Douglas MacArthur, does. Just as H.L. Mencken thought uber militarist Ludendorf walked on water in a gushing panegyric he had written of Ludendorf in 2015, I think
it was.

"Fraenkel also noted that American law recognizes the proposition that activity by the state under conditions of martial law is not “legal activity in the proper sense,” citing to what Justice Field said in ex parte Milligan:
“People imagine, when they hear the _expression_ ‘martial law,’ that there is a system of law known by that name, which can upon occasion be substituted for the ordinary system; and there is a prevalent notion that under certain circumstances a military commander
may, by issuing a proclamation, displace one system, the civil law, and substitute another, the martial. . . . Let us call the thing by its right name; it is not martial law, but martial rule.”[13]
That is what Trumpites, to include the many other Republican/Conservatives like Tom Cotton, pine for: martial rule! These anti-Constitutionalists should be denounced in the strongest terms, instead of pretending they aren’t the constitutional subversives that
they are, with their elaborate fabrications of an "Originalist Constitutional theory,” while they upheld the worst forms of torture and military rule at places like Guantanamo and the many “Black Sites” that were maintained by our many war criminals, blessed
with impunity. That is the so-called U.S. “Rule-Based International Order” in actual fact.
