[Salon] USIP Legal Update

Dear Friends and Supporters,

We had hoped for better news on USIP’s legal situation.  However, on Thursday, July 24th, the Court of Appeals for the D.C. Circuit denied USIP’s petition for en banc review of the stay decision.  Below is the public statement that was issued from George.  

The road ahead will not be easy or quick.  However, the USIP lawyers and the Department of Justice have agreed that all filings for the hearing on the merits of USIP’s case will be submitted by mid-October.  After that it will be up to the court on when/whether they will hear oral arguments and when they will make a decision.  

And, as many of you may have seen, two of the three remaining Board members, Secretaries Rubio and Hegseth, have just named the third acting President since the take-over of USIP. His name is Darren Beattie, currently also at the State Department.  

Given the court schedule we will likely not be communicating much over the next two or three months.  Thank you for your continuing interest and support,

Statement from Ambassador George Moose (July 24, 2025)

“Today the Court of Appeals for the D.C. Circuit denied the U.S. Institute of Peace’s petition for en banc review of the June 27 decision by a three-judge panel of the Court granting the government’s request for a stay of Judge Beryl Howell’s May 19 ruling. USIP will continue to fight through the appeals process to regain control of the organization and its assets – including its headquarters – and to fulfill its congressionally mandated mission. Judge Howell’s ruling confirmed USIP’s independent status and held all of the actions to dismantle the Institute that followed to be null and void, including the illegal firing of hundreds of employees.

We are confident that the Court of Appeals will ultimately agree with USIP on the merits. USIP remains committed to resuming its essential work in preventing, mitigating, and helping parties in conflict around the world peacefully resolve disputes.”
